INGHAM COUNTY BOARD OF COMMISSIONERS

RESOLUTION TO COLLECT A $12.00 BOOKING FEE PURSUANT TO

PA 125 OF 2003

RESOLUTION #03-297

WHEREAS, PA 125 of 2003 authorizes the Ingham County Sheriff's Office to collect a $12.00 booking fee for inmates entering the County Jail; and

WHEREAS, PA 125 of 2003 creates the Local Corrections Officers Training Fund within the State Treasury; and

WHEREAS, pursuant to PA 125 of 2003, the money collected from the booking fees must be remitted quarterly to the State Treasury; and

WHEREAS, the Ingham County Sheriff's Office will be eligible to receive grants from this fund for training purposes; and

WHEREAS, should the Sheriff's Coordinating and Training Council certify the County's standards and requirements for training corrections officers, $10 of each fee charged can be retained by the County for continued education and training of corrections officers, and inmate programs that include substance abuse and mental health.

THEREFORE BE IT RESOLVED, that the Ingham County Board of Commissioners authorizes the Sheriff to collect a $12.00 booking fee from jail inmates effective November 13, 2003.

BE IT FURTHER RESOLVED, that a person who is incarcerated in the Ingham County Jail pending trial or arraignment is entitled to a full refund of the fee paid under this policy if the prosecution against him or her is terminated for any reason or if he or she is found not guilty of the charges.

BE IT FURTHER RESOLVED, that a person wanting to obtain a refund of the fee paid shall complete and submit the necessary paperwork.

BE IT FURTHER RESOLVED, that the Ingham County Board of Commissioners authorizes the Controller to make any necessary adjustments in the Ingham County Sheriff's Office 2003 Budget.
